BakBak - Privacy Policy

This Privacy Policy of MOBCLICK TECHNOLOGY (HK) LIMITED , (“BakBak, “us”, “we”, or “our”) which is incorporated into and is subject to our Terms of Use. It explains the storage, disclosure, use, transfer and other processing of your data (Personal & Non-Personal) and usage and sharing of contents. Hence, before start using this application or giving information about you, kindly review this Privacy Policy. By using or accessing our “BakBak” application, you agree that we can store and process the data about yourself in accordance to this Policy which is revised time to time. Information we take about yourself and how we use it for you

1a) If allowed, we access your photos, media and files to facilitate you to download photos to your gallery. If allowed, we access your storage file system, read and modify the contents of your storage.

1b) When you log in from Facebook, we take your username, location, your age range, and Gender Info to provide you the best contents that you like most

1c) If allowed, we can track your location through GPS based on your SIM card, IP address or mobile device location settings to provide you  personalized Contents.

1d) If allowed, we access your Phone to read phone status, identity and Unique device ID of your device.

2a) When you connect to our application, we take some non-personal data about yourself like the Android model, version, and browser, resolution of your mobile phone, IMEI, Language, network, unique mobile identifier, Mobile carriers, Cookies and other such information

2b) We store the data that you fill in your profile which include your Name, Email address, Phone number, Date of Birth, Education and other similar information

2c) We collect your behavioural data like contents you like/comment/share and social media login details (Upon logged in) to provide you personalized service.

2d) We also keep a record of your usage history like Clicks on different Events, Exit pages/Screens on our services etc. to improve your experiences better with us.

2e) Cookies: We use Cookies and data from log files to store information and data so that your experience will be quicker. It reduces your labor to re-enter the same information when you visit us next time and update a new version of our application. However, you have an option to either decline or accept to give us access to your cookies.

3a) To provide localized advertisements and offers, personalized content, and our best services

3b) Facilitate certain activities on our platform like uploading/downloading photos and, posting comments etc.

3c) Helps you to find and invite your friends (Contacts/WhatsApp/Facebook) into our platform and make your own family to entertain yourself

3d) Helps in research and statistical analysis of users to make business decisions

3e) To improve and develop our Platform and conduct product development

3f) To help us detect abuse, fraud, and illegal activity on the Platform and communicate to you

4a) Personal Information: In general, we use Session and Usage Data internally to serve our Users and enable them to take maximum advantage of the Applications, the Services and the Site. We do not disclose your Personal Information. Though information aggregate maybe provide to partners so as to provide tailored ads and notifications to users

4b) Non-Personal Information: We may disclose Non-Personal Information to our trusted partners who shall comply with this privacy policy and the relevant privacy laws. We do not combine Non-Personal Information with Personal Information (such as combining your name with your unique User Device number).

To ensure that BakBak remains a safe and respectful platform, we've created standards defining and prohibiting content that is harmful or inappropriate for our users. If the user violates the terms, the account will be banned.

We don't allow UGC that contain or promote sexual content or profanity, including pornography, or any content or services intended to be sexually gratifying. We don’t allow content that appear to promote a sexual act in exchange for compensation.

Examples of common violations

• Depictions of sexual nudity, or sexually suggestive poses in which the subject is nude, blurred or minimally clothed, and/or where the clothing would not be acceptable in an appropriate public context.
• Depictions, animations or illustrations of sex acts, or sexually suggestive poses or the sexual depiction of body parts.
• Content that depicts or are functionally sexual aids, sex guides, illegal sexual themes and fetishes.
• Content that is lewd or profane - including but not limited to content which may contain profanity, slurs, explicit text, adult/sexual keywords in the store listing or in-app.
• Content that depicts, describes, or encourages bestiality.
• Users that promote sex-related entertainment, escort services, or other services that may be interpreted as providing sexual acts in exchange for compensation, including but not limited to compensated dating or sexual arrangements where one participant is expected or implied to provide money, gifts, or financial support to another participant

6a) Any user content will be considered non-confidential and non-proprietary.

6b) Users shall be solely responsible for their own content and the consequences of submitting and publishing their content on the Services.

6c) We do not endorse any content submitted to the Services by any user or any opinion, recommendation, or advice expressed therein, any use or reliance on any content obtained through the Service is at your own risk.

6d) Any views and opinions expressed by users on the Platform do not necessarily reflect the policy or position of the Platform.

6e) We reserve the right to remove content that violates The Agreement, Community Guidelines, Google Policy of Restricted Contents and other policies that apply to your use of the Service

6f) When you post your content through the Service, you agree and represent that you own that content or you have received permission from the owner of any part of the content submitted to the Services.

BakBak is a Technology Provider which enable users and Authors to share their views and Interests. We provide BakBak technology platform to Authors for publishing of contents. All Contents are reviewed before they are online to ensure that it does not violate any Policies for Restricted Contents.

8a) Websites/Platform which given authorization shall recommend to the users

8b) BakBak: BakBak platform which generates the contents ( pictures, videos, images, Gifs) from the general public who agreed our BakBak policy, had uploaded the contents (pictures, videos, images) as per the Copyright Act, 1957, by their free will and interest, the BakBak App is not responsible in any form/condition violating the Copyright Act, 1957.

8c) BakBak Platform accepting any individual to join the platform to become our BakBak Content Sharing Partnership followed by the content contribution policy, that if, any contributor has violated the copyright of any other will be removed and will be terminated the Partnership. If you found anyone violating anyone’s rights in terms of the contents (pictures, videos, images, Gifs) please contact us to resolve the issue.

If you find any Improper/Restricted Contents on our App. Please, remember that BakBak didn’t endorse any contents. However, one can report any contents in the application with a reason of reporting like Content Infringement, Objectionable Content etc. We will review that content immediately and if it violates any policy, we will immediately remove that content and may block that user/Partner.

Our Service includes links to other apps or Websites whose privacy practices may differ from us. If you submit personal information to any of those sites, your information is governed by their privacy statements. We encourage you to carefully read the privacy statement of any Web site you visit. Any contents found on third party sites don’t belong to us and they are controlled by the owner of the respective sites.

11a) We are not responsible if you provide us with the wrong information regarding your Paytm account and PAN Card. Authenticity is your own responsibility

11b) Registering bulk virtual phone numbers (E.g. from “TextNow” application) to get OTP to register and fill in the invitation code to earn money illegally is subject to legal actions as per rules of Govt. of India

11c) We don’t pay to Non-Indian registered numbers

11d) If you use the same phone or emulator to fill in a number of Invitations and If you are logging in with multiple accounts repeatedly with the same cell phone or by using app-dividing software, These actions are subjected to illegal activities and we may take legal actions against the user if applicable.

11e) When user withdraws money from BakBak, TDS will be deducted as per the government rules.

The BakBak Products and Services are not intended for the children below the age of 18 years and BakBak products are strictly prohibited for children less than 13 years old.

In order to improve the user experience of the BakBak application, users may leave comments on particular images and Articles but BakBak does not endorse these comments because they are the opinions of users who are not directly associated with BakBak and its affiliated elements. Please remember that any information that is disclosed in these areas becomes public information. Parties may view and collect any such information. As such, you should be cautioned when deciding to disclose Personal Information.

14a) Your information may be used for the presentation of advertisements. We may use ad networks to customize and display advertising on our Services. We may share certain information about you as a user (such as age or other information we have collected or received) with certain ad network and service providers to help them deliver more relevant content and advertisements through their networks.

14b) We may use third-party advertising companies to serve advertisements when you visit or use our application. These companies may use information about your visits or use to particular services to provide advertisements about goods and services of interest to you.

14d) We bring relevant offers to users for their benefit. These offers may include personal loan offers, shopping offers and others. We are neither a distributor nor affiliated with an ad agency or company promoting their products in BakBak.

14c) We will not disclose any of your personal information to any third party. Though information aggregate maybe provide to partners so as to provide tailored ads and notifications to users. We can also give it to some government Institutions if and only if it is permitted by the Law of Govt of India.

14d) We cannot, and do not, control the information that you share with other Users using an Application, the Services and how such other Users will use or share such information. We are not responsible for third party circumvention of our security measures.

14e) When you share our application/contents or link your user profile to some third parties like Facebook, WhatsApp, Instagram etc. they might receive your personal and non-personal information like Name, Email address, Date of Birth, Age etc. We are not responsible for that kind of sharing of data as we don’t/can’t control it. By agreeing to our Privacy Policy, you accept this fact.

Your personal and non-personal information may be stored and processed in any countries where we provide our services as described in the Privacy Policy. By agreeing to our Privacy Policy and using our Application you consent to transfer your personal and non-personal information to us despite the fact that different countries have different data protection rule. If you object to your Personal/non-personal Information being processes as described in this Policy, Please do not use this Application. According to California Civil Code section 1798.83, California residents reserve the right on the disclosure of their personal information to third parties. In that case, you may contact us on the below mentioned email with Subject “California Users’ Civil Right”.

We reserve the right to change, modify and alter this Privacy Policy at any time. It is your responsibility to keep checking it and stay updated on a regular basis. Your continuous use of this application following the posting of any changes/modifications to the Privacy Policy constitutes your acceptance of the revised Privacy Policy

If you choose to visit the Apps/Services, your visit and any dispute over privacy is subject to this Privacy Policy and the Apps/Services' terms of use. In addition any disputes arising under this Privacy Policy shall be strictly governed by the laws of India

What happens if I permanently delete my BakBak account?

• You won't be able to reactivate your account
• Your profile, photos, posts, videos, and everything else you've added will be permanently deleted. You won't be able to retrieve anything you've added.
• You'll no longer be able to use BakBak.
• Some information, like messages you sent to friends, may still be visible to them after you delete your account. Copies of messages you have sent are stored in your friends' inboxes.

How do I permanently delete my account?

To permanently delete your account:

1. From your "Personal" page, click "Settings" in the right of BakBak.
2. Select "Account cancellation".
3. Read and agree the rules.
4. Click "cancellation".

Can I cancel my account deletion?

If it's been less than 30 days since you initiated the deletion, you can cancel your account deletion. After 30 days, your account and all your information will be permanently deleted, and you won't be able to retrieve your information.

It may take up to 90 days from the beginning of the deletion process to delete all the things you've posted. While we're deleting this information, it's not accessible to other people using BakBak.

Copies of your information may remain after the 90 days in backup storage that we use to recover in the event of a disaster, software error, or other data loss event. We may also keep your information for things like legal issues, terms violations, or harm prevention efforts.
